On 26 September 2002 legislation enacted by the Parliament of the Commonwealth of Australia outlawed genocide, war crimes and crimes against humanity: Division 268, Criminal Code Act. Australia is demonstrably "unwilling and unable" to investigate and prosecute Aboriginal Genocide claims and thus the International Criminal Court has jurisdiction.
